1. About these terms
These terms are an agreement between you and Attribute AI, LLC, a United States limited liability company that operates MedSkift (“MedSkift”, “we”, “us”), for use of the MedSkift website and apps. By creating an account you accept them, together with our privacy notice and, for employers, our credit terms.
2. What MedSkift does, and does not do
MedSkift is an online marketplace. Employers (hospitals, clinics, pharmacies, care homes, agencies and individuals) post shifts; health workers apply; the employer chooses whom to book.
MedSkift is not an employer or an employment agency and is not a party to the arrangement between an employer and a health worker. The employer and the health worker agree the work and the rate shown on the shift, and the employer pays the health worker directly. Each is responsible for their own obligations, including tax, labour law, professional indemnity, supervision, induction and workplace safety.
3. Accounts
- You must be 18 or older and able to enter into a binding agreement.
- Keep your details accurate and your email account secure: we sign you in with one-time codes sent to it.
- One person, one account. Members of an organization act for it within the role the organization gives them.
- You are responsible for what happens under your account.
4. Verification
Health workers must complete an identity check and, where their profession is regulated, hold current registration and a valid practising certificate before applying. The owner of every organization completes an identity check, and organizations provide the business documents we ask for before publishing shifts.
You confirm that everything you submit is genuine, current and yours. We may refuse, suspend or withdraw verification, for example when a document expires, cannot be confirmed with the issuing council or appears altered. Verification lowers risk but is not a guarantee of anyone’s conduct or competence; employers remain responsible for their own checks and supervision.
5. Posting and booking shifts
- Shifts must be real, lawful and described accurately, including the site, hours, requirements and rate.
- Rates must comply with applicable law. You must pay booked health workers the agreed rate, directly and on time.
- Provide a safe workplace, the induction and supervision the role needs, and honest information to the worker.
- Accepting an applicant creates a booking and charges the booking fee of US$3 per booked shift from your organization’s prepaid credit, as set out in the credit terms.
6. Applying and working shifts
- Only apply for shifts you are qualified, registered and fit to work, and practise within your scope.
- Keep your practising certificate and other required documents current; expiry pauses applications.
- Turn up on time for booked shifts and follow the employer’s reasonable instructions and policies.
- MedSkift is free for health workers and takes nothing from your pay.
7. Cancellations and no-shows
Either side can cancel a booking before the shift starts. If the health worker cancels, or does not turn up and the employer reports it within 24 hours of the start, the booking fee is refunded to the employer’s credit. If the employer cancels at least 24 hours before the start the fee is refunded; later than that, it is kept.
A health worker who cancels less than 24 hours before a shift, or does not turn up, receives a strike. Three strikes within 90 days pauses new applications until our team has reviewed the account. Our team may also cancel bookings and resolve disputes, recording the reason.
8. Messages, reviews and conduct
Before a booking exists, contact details in messages are hidden automatically. Do not try to get around this, and do not use MedSkift to harass, discriminate against, mislead or spam anyone, to post unlawful content, or to interfere with the service or other people’s accounts.
Reviews must be honest and based on a real, completed shift. We may hide reviews that break these terms. Any message can be reported, and our team may read a reported conversation to investigate.
9. Suspension and closing accounts
We may suspend or close an account that breaks these terms, puts patients or other users at risk, or is required to be closed by law, and we will tell you why unless the law or safety prevents it. You can delete your account at any time in Settings, as described in our privacy notice.
10. Our responsibility to you
We work hard to keep MedSkift available, accurate and secure, but the service is provided “as is” and may sometimes be interrupted. To the extent the law allows, MedSkift is not liable for the acts or omissions of employers or health workers, for care delivered during a shift, or for indirect or consequential losses, and our total liability to an organization in any 12 months is limited to the booking fees it paid us in that period.
Nothing in these terms excludes liability that cannot be excluded under Zimbabwean law.
11. Law and disputes
These terms are governed by the laws of Zimbabwe. If something goes wrong, contact us first at support@medskift.com and we will try to resolve it. Otherwise, the courts of Zimbabwe have jurisdiction.
12. Changes
We may update these terms as MedSkift grows. We will post the new version here and tell you by email or in the app before significant changes take effect. Continuing to use MedSkift after that means you accept them.
